By downloading, installing, or using EthervoxAI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

EthervoxAI grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

2.1 License Restrictions

You may not:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Use the App to harm, threaten, or harass others
• Redistribute or resell the App or any part of it

3. Service Tiers

3.1 Free Tier with Ads

• Full access to core AI assistant functionality
• Supported by personalized advertising (requires consent)
• Ad-free experience available via Premium upgrade

3.2 Premium Tier

• Ad-free experience
• All features of Free Tier
• Subscription-based pricing as displayed in the App
• Subscriptions are billed monthly or annually through Google Play

4. Subscriptions and Billing

4.1 Payment Processing

All payments are processed through Google Play. By subscribing to Premium, you agree to Google Play's terms and billing policies.

4.2 Automatic Renewal

Premium subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Manage your subscription through Google Play.

4.3 Refunds

Refund requests are subject to Google Play's refund policy. Contact Google Play support for refund inquiries.

4.4 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Continued use after price changes constitutes acceptance.

5. Privacy and Data Processing

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Points:

• All AI processing occurs locally on your device
• Conversations are encrypted and stored only on your device
• We do not collect or store your conversations
• Free Tier users: Advertising requires separate consent (can be declined by upgrading to Premium)

6. Acceptable Use Policy

You agree not to use the App to:

• Generate harmful, illegal, or abusive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Spread misinformation, spam, or malware
• Impersonate others or misrepresent your identity
• Attempt to manipulate, exploit, or harm the AI system

7. Intellectual Property

7.1 Our IP

The App, including all content, features, functionality, and AI models, is owned by EthervoxAI and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you create using the App. Since all processing is local, we do not claim rights to your conversations or user-generated content.

7.3 Third-Party Models

The App uses open-source AI models from Hugging Face. These models are subject to their respective licenses. Commercial use may require additional licensing.

8. Disclaimers and Warranties

8.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 AI Limitations

We do not guarantee that:

• The App will be error-free or uninterrupted
• AI responses will be accurate, complete, or reliable
• The App will meet your specific requirements
• Any errors or defects will be corrected

8.3 Not Professional Advice

The App is for informational and entertainment purposes only. It does not provide medical, legal, financial, or professional advice. Do not rely on AI-generated content for critical decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETHERVOXAI SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, OR GOODWILL
• DAMAGES RESULTING FROM AI-GENERATED CONTENT OR ERRORS
• DAMAGES EXCEEDING THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS

10. Indemnification

You agree to indemnify and hold harmless EthervoxAI from any claims, damages, losses, liabilities, and expenses arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you generate or share using the App

11. Termination

11.1 By You

You may stop using the App at any time by uninstalling it from your device. Premium subscriptions can be canceled through Google Play.

11.2 By Us

We may suspend or terminate your access to the App if you violate these Terms or engage in harmful behavior. Termination does not entitle you to a refund.

11.3 Effect of Termination

Upon termination, your license to use the App ends immediately. All locally stored data remains on your device until you delete the App.

12. Updates and Modifications

12.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. You are responsible for installing updates to continue using the App.

12.2 Terms Updates

We may modify these Terms at any time. Material changes will be notified through the App. Continued use after changes constitutes acceptance.

13. Third-Party Services

The App integrates with third-party services (Google Play, AdMob, Hugging Face). You are responsible for complying with their respective terms of service:

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the United States and the state where EthervoxAI is registered, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a legal claim, you agree to contact us at support@ethervox.ai to attempt informal resolution.

14.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EthervoxAI.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

15.3 Waiver

Failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for failures or delays caused by events beyond our reasonable control.

16. Open Source

The App may include open-source software components. Those components are governed by their respective open-source licenses, which are available in the App's "About" section.

17. Export Compliance

You agree to comply with all applicable export and import laws when using the App. You may not use the App in countries subject to U.S. trade embargoes.

18. Children's Privacy

The App is not intended for children under 13 (or 16 in the EU). If you are under 18, you must have parental consent to use the App.
